Legionella Pneumophila Bacterium

A Legionnaires disease claim for compensation is not such a rare event and each year in the UK there are approximately 200 cases of this condition which is caused by inhaling a fine spray of water carrying the legionella pneumophila bacterium. All evidence currently shows that this disease is not transmitted from person to person or by drinking water carrying the bacterium. Symptoms of the disease include fever, chills, headache, muscle pain and a dry cough however the condition can be extremely dangerous particularly in the elderly and can result in pneumonia and in severe cases can ultimately lead to death.

Defective Equipment

The legionella pneumophila bacterium is often found in hot water systems and in general is not particularly dangerous, however contaminated water may spray from equipment including air conditioning plants, cooling towers, industrial sprays and showers at which point the bacterium can become very dangerous. The infection is contracted by breathing in the contaminated water spray from this type of equipment. Outbreaks usually occur near large buildings such as hotels, hospitals, offices and factories with defective or poorly maintained equipment usually situated on the roof allowing the contaminated spray to affect all passersby.

Approved Code of Practice

Upon investigation of an outbreak it will often be revealed that all of the sufferers have been at or near the same location. It may be possible to prosecute under the Health & Safety at Work Act 1974 or the Control of Substances Hazardous to Health Regulations 1988 if the owner of the faulty equipment has not complied with the Approved Code of Practice for the equipment in question. In addition a Legionnaires disease claim for compensation can be started in the civil courts either on an individual basis or as part of a group of victims.

Group Legal Action

The risks and hazards of this condition are or should be, well known to the operators of large buildings or of spray equipment who will be held liable to pay compensation to anyone who suffers personal injury or loss as a result of contracting this disease. Due to the large number of people that may become infected, in the event of the proposed defendant denying liability for negligence and refusing to pay compensation it may be possible to pursue group legal action which considerably reduces risk and expenses with all victims claims effectively resting on a few typical test cases.
